中共中央 国务院关于加快建设全国统一大市场的意见

建设全(quan)(quan)国统(tong)一大(da)市(shi)场是构建新(xin)发(fa)展格(ge)局的基础支撑和内在要求。为从(cong)全(quan)(quan)局和战(zhan)略(lve)高度(du)加快建设全(quan)(quan)国统(tong)一大(da)市(shi)场,现提出如下意见。


一、总体要求


(一(yi))指导思想(xiang)。以习近(jin)平(ping)(ping)新(xin)时代(dai)中国(guo)特(te)色社会主(zhu)义思想(xiang)为(wei)(wei)指导,全(quan)面(mian)贯(guan)彻党的(de)十(shi)九大(da)和(he)(he)十(shi)九届历(li)次全(quan)会精神,弘扬伟(wei)大(da)建(jian)(jian)(jian)党精神,坚(jian)持(chi)稳中求进工作总基调,完整、准确、全(quan)面(mian)贯(guan)彻新(xin)发展理(li)念,加快(kuai)构建(jian)(jian)(jian)新(xin)发展格局,全(quan)面(mian)深化改革开放(fang),坚(jian)持(chi)创新(xin)驱(qu)动发展,推(tui)动高(gao)质(zhi)量发展,坚(jian)持(chi)以供(gong)给(ji)侧结(jie)构性改革为(wei)(wei)主(zhu)线,以满足人民日益增长的(de)美好生(sheng)活需(xu)要(yao)为(wei)(wei)根(gen)本目的(de),统筹发展和(he)(he)安全(quan),充(chong)分(fen)发挥(hui)法(fa)治的(de)引(yin)领、规范(fan)、保障作用,加快(kuai)建(jian)(jian)(jian)立全(quan)国(guo)统一(yi)的(de)市(shi)(shi)(shi)场制度规则(ze),打破地方保护和(he)(he)市(shi)(shi)(shi)场分(fen)割,打通制约经(jing)济循(xun)环的(de)关键堵点,促进商品要(yao)素资源(yuan)在(zai)更大(da)范(fan)围内畅通流动,加快(kuai)建(jian)(jian)(jian)设(she)(she)高(gao)效规范(fan)、公平(ping)(ping)竞争(zheng)、充(chong)分(fen)开放(fang)的(de)全(quan)国(guo)统一(yi)大(da)市(shi)(shi)(shi)场,全(quan)面(mian)推(tui)动我国(guo)市(shi)(shi)(shi)场由大(da)到强(qiang)转变,为(wei)(wei)建(jian)(jian)(jian)设(she)(she)高(gao)标准市(shi)(shi)(shi)场体系、构建(jian)(jian)(jian)高(gao)水(shui)平(ping)(ping)社会主(zhu)义市(shi)(shi)(shi)场经(jing)济体制提供(gong)坚(jian)强(qiang)支撑。


(二)工作原则


——立(li)足(zu)内需(xu),畅(chang)通(tong)循环。以(yi)高质量供(gong)给创(chuang)造和引领需(xu)求(qiu),使(shi)生产、分配、流通(tong)、消费(fei)各环节(jie)更加畅(chang)通(tong),提高市场(chang)运行(xing)效率,进一步巩(gong)固和扩展市场(chang)资源优势,使(shi)建设超大规模的国内市场(chang)成为一个可持续的历史过程(cheng)。


——立破并(bing)举,完善制度(du)(du)。从制度(du)(du)建(jian)设着(zhe)眼,明确阶(jie)段性目标要求,压茬(cha)推进(jin)统(tong)一市(shi)场建(jian)设,同时坚持问题(ti)导(dao)向(xiang),着(zhe)力解决突出(chu)矛盾(dun)和(he)问题(ti),加快清理(li)废(fei)除妨(fang)碍统(tong)一市(shi)场和(he)公平竞争的各种(zhong)规定和(he)做法,破除各种(zhong)封(feng)闭小市(shi)场、自(zi)我小循环。


——有(you)效(xiao)市场(chang)(chang),有(you)为政(zheng)府(fu)。坚持市场(chang)(chang)化、法(fa)治化原则,充分(fen)发挥市场(chang)(chang)在资(zi)源配(pei)置中的(de)决(jue)定性作用,更(geng)好发挥政(zheng)府(fu)作用,强化竞(jing)争(zheng)政(zheng)策基础地(di)位,加(jia)快(kuai)转变(bian)政(zheng)府(fu)职能,用足用好超大规模市场(chang)(chang)优(you)势,让(rang)需求(qiu)(qiu)更(geng)好地(di)引领优(you)化供给,让(rang)供给更(geng)好地(di)服务扩大需求(qiu)(qiu),以统一大市场(chang)(chang)集聚资(zi)源、推(tui)动增长、激励(li)创新(xin)、优(you)化分(fen)工、促(cu)进竞(jing)争(zheng)。


——系统(tong)(tong)协(xie)同,稳(wen)妥推(tui)进(jin)(jin)。不(bu)断提高政策的(de)统(tong)(tong)一(yi)性(xing)、规则的(de)一(yi)致性(xing)、执行的(de)协(xie)同性(xing),科学把(ba)握市(shi)场(chang)(chang)(chang)规模、结构(gou)、组(zu)织、空间、环境和(he)机制建设(she)的(de)步骤与进(jin)(jin)度,坚持放(fang)管结合(he)、放(fang)管并重,提升政府监管效能,增(zeng)强在(zai)开放(fang)环境中动(dong)态维护市(shi)场(chang)(chang)(chang)稳(wen)定、经济安全的(de)能力(li),有序扩大统(tong)(tong)一(yi)大市(shi)场(chang)(chang)(chang)的(de)影响(xiang)力(li)和(he)辐射力(li)。


(三)主要目标


——持续推动国(guo)内市(shi)(shi)(shi)场(chang)(chang)高效畅(chang)通(tong)(tong)(tong)和规模拓展。发挥(hui)市(shi)(shi)(shi)场(chang)(chang)促进(jin)竞争、深(shen)化(hua)分工等优(you)势,进(jin)一步(bu)打(da)通(tong)(tong)(tong)市(shi)(shi)(shi)场(chang)(chang)效率提升(sheng)、劳(lao)动生产(chan)(chan)率提高、居民收(shou)入增加、市(shi)(shi)(shi)场(chang)(chang)主体壮大、供(gong)给质量(liang)提升(sheng)、需求优(you)化(hua)升(sheng)级之(zhi)间的通(tong)(tong)(tong)道,努力形成供(gong)需互促、产(chan)(chan)销并进(jin)、畅(chang)通(tong)(tong)(tong)高效的国(guo)内大循环,扩大市(shi)(shi)(shi)场(chang)(chang)规模容量(liang),不断培(pei)育(yu)发展强大国(guo)内市(shi)(shi)(shi)场(chang)(chang),保持和增强对全球企业(ye)、资(zi)源的强大吸引力。


——加快(kuai)营(ying)造(zao)稳定公(gong)平(ping)透明可预期的营(ying)商环(huan)境。以市场主(zhu)体需求为导向(xiang),力行简(jian)政之(zhi)道(dao),坚(jian)持依(yi)法行政,公(gong)平(ping)公(gong)正监管,持续优(you)化服务,加快(kuai)打造(zao)市场化法治化国际化营(ying)商环(huan)境。充分发挥各(ge)地区比较优(you)势(shi),因地制宜(yi)为各(ge)类市场主(zhu)体投资兴业营(ying)造(zao)良好生态。


——进(jin)一步降低(di)市场(chang)交易成本(ben)。发(fa)挥市场(chang)的规模效(xiao)(xiao)应和集聚(ju)效(xiao)(xiao)应,加强(qiang)和改进(jin)反垄断反不(bu)正当(dang)竞(jing)争(zheng)执法司法,破除妨(fang)碍各(ge)种(zhong)生产(chan)要素市场(chang)化配置和商品服(fu)务流(liu)通(tong)的体制机制障碍,降低(di)制度性交易成本(ben)。促进(jin)现代流(liu)通(tong)体系建设,降低(di)全社(she)会流(liu)通(tong)成本(ben)。


——促(cu)(cu)进(jin)(jin)科技创新(xin)和产业升级(ji)。发挥超大规模(mo)市场具有丰(feng)富应用场景和放大创新(xin)收益(yi)的优(you)势,通过市场需求引导创新(xin)资源有效配置(zhi),促(cu)(cu)进(jin)(jin)创新(xin)要素有序流动(dong)和合理配置(zhi),完善促(cu)(cu)进(jin)(jin)自主创新(xin)成果市场化(hua)应用的体制机(ji)制,支撑科技创新(xin)和新(xin)兴产业发展(zhan)。


——培育参与国际(ji)竞(jing)争合作新优势。以国内大循环和统(tong)一大市(shi)场为支撑,有效利用(yong)全(quan)球要素和市(shi)场资源(yuan),使国内市(shi)场与国际(ji)市(shi)场更(geng)好联通。推动制度型(xing)开放,增强在(zai)全(quan)球产业链(lian)(lian)供应链(lian)(lian)创新链(lian)(lian)中(zhong)的(de)影响力(li),提升在(zai)国际(ji)经(jing)济(ji)治理(li)中(zhong)的(de)话语权。


二、强化市场基础制度规则统一


(四)完(wan)善(shan)统(tong)一(yi)(yi)的产权(quan)保护(hu)制度(du)。完(wan)善(shan)依法(fa)(fa)(fa)平等保护(hu)各种所有(you)制经济产权(quan)的制度(du)体系。健(jian)全统(tong)一(yi)(yi)规范的涉(she)产权(quan)纠(jiu)纷案件执(zhi)(zhi)法(fa)(fa)(fa)司法(fa)(fa)(fa)体系,强(qiang)化执(zhi)(zhi)法(fa)(fa)(fa)司法(fa)(fa)(fa)部门协同,进一(yi)(yi)步规范执(zhi)(zhi)法(fa)(fa)(fa)领域(yu)涉(she)产权(quan)强(qiang)制措施规则和程序,进一(yi)(yi)步明确和统(tong)一(yi)(yi)行(xing)政执(zhi)(zhi)法(fa)(fa)(fa)、司法(fa)(fa)(fa)裁判标(biao)准,健(jian)全行(xing)政执(zhi)(zhi)法(fa)(fa)(fa)与(yu)刑事司法(fa)(fa)(fa)双(shuang)向衔接(jie)(jie)机制,依法(fa)(fa)(fa)保护(hu)企(qi)业(ye)产权(quan)及(ji)企(qi)业(ye)家(jia)人身财(cai)产安全。推动知识产权(quan)诉讼制度(du)创新(xin),完(wan)善(shan)知识产权(quan)法(fa)(fa)(fa)院跨区域(yu)管辖制度(du),畅通知识产权(quan)诉讼与(yu)仲裁、调解(jie)的对(dui)接(jie)(jie)机制。


(五)实(shi)行(xing)统(tong)一(yi)的(de)(de)(de)市(shi)场(chang)准(zhun)入(ru)制度(du)。严(yan)格落实(shi)“全(quan)国(guo)一(yi)张清(qing)(qing)单”管理模式,严(yan)禁各地区(qu)各部门自(zi)行(xing)发布具有市(shi)场(chang)准(zhun)入(ru)性(xing)质(zhi)的(de)(de)(de)负面(mian)清(qing)(qing)单,维(wei)护市(shi)场(chang)准(zhun)入(ru)负面(mian)清(qing)(qing)单制度(du)的(de)(de)(de)统(tong)一(yi)性(xing)、严(yan)肃性(xing)、权威(wei)性(xing)。研究完善(shan)市(shi)场(chang)准(zhun)入(ru)效能评(ping)估指标,稳(wen)步开展市(shi)场(chang)准(zhun)入(ru)效能评(ping)估。依法开展市(shi)场(chang)主体登(deng)(deng)(deng)记注册工作,建立全(quan)国(guo)统(tong)一(yi)的(de)(de)(de)登(deng)(deng)(deng)记注册数据标准(zhun)和企业(ye)名称(cheng)自(zi)主申报行(xing)业(ye)字词库,逐步实(shi)现经营范(fan)围登(deng)(deng)(deng)记的(de)(de)(de)统(tong)一(yi)表述。制定(ding)全(quan)国(guo)通(tong)用性(xing)资格清(qing)(qing)单,统(tong)一(yi)规范(fan)评(ping)价程序(xu)及管理办法,提升全(quan)国(guo)互(hu)通(tong)互(hu)认互(hu)用效力。


(六)维护统一的公(gong)(gong)平(ping)竞争制(zhi)度。坚持对(dui)各类市(shi)场主体一视同仁(ren)、平(ping)等对(dui)待。健(jian)(jian)全(quan)公(gong)(gong)平(ping)竞争制(zhi)度框架和政策(ce)实(shi)施机制(zhi),建立公(gong)(gong)平(ping)竞争政策(ce)与产(chan)业政策(ce)协(xie)调(diao)保障机制(zhi),优(you)化完(wan)善产(chan)业政策(ce)实(shi)施方(fang)式。健(jian)(jian)全(quan)反(fan)垄断法律规则体系,加(jia)快推(tui)动修改反(fan)垄断法、反(fan)不正当竞争法,完(wan)善公(gong)(gong)平(ping)竞争审查(cha)制(zhi)度,研究(jiu)重点领(ling)域和行业性审查(cha)规则,健(jian)(jian)全(quan)审查(cha)机制(zhi),统一审查(cha)标准(zhun),规范(fan)审查(cha)程序,提(ti)高审查(cha)效能(neng)。


(七)健全(quan)(quan)统一的(de)(de)社会信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)制(zhi)(zhi)度(du)(du)。编制(zhi)(zhi)出台(tai)全(quan)(quan)国(guo)公(gong)共(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)基(ji)础(chu)(chu)目录,完(wan)善信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)标(biao)准,建(jian)(jian)立公(gong)共(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)同金融信(xin)(xin)(xin)息(xi)共(gong)享整合(he)机(ji)(ji)制(zhi)(zhi),形(xing)成(cheng)覆(fu)盖全(quan)(quan)部信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)主体、所有(you)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)类别、全(quan)(quan)国(guo)所有(you)区(qu)域(yu)的(de)(de)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)网络(luo)。建(jian)(jian)立健全(quan)(quan)以(yi)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)为基(ji)础(chu)(chu)的(de)(de)新型监(jian)管机(ji)(ji)制(zhi)(zhi),全(quan)(quan)面推(tui)广信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)承(cheng)诺制(zhi)(zhi)度(du)(du),建(jian)(jian)立企业信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)状况综合(he)评价体系(xi),以(yi)信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)风险(xian)为导向优(you)化配置(zhi)监(jian)管资(zi)源,依法(fa)(fa)依规编制(zhi)(zhi)出台(tai)全(quan)(quan)国(guo)失信(xin)(xin)(xin)惩(cheng)(cheng)戒(jie)措施基(ji)础(chu)(chu)清单。健全(quan)(quan)守(shou)信(xin)(xin)(xin)激(ji)励和失信(xin)(xin)(xin)惩(cheng)(cheng)戒(jie)机(ji)(ji)制(zhi)(zhi),将失信(xin)(xin)(xin)惩(cheng)(cheng)戒(jie)和惩(cheng)(cheng)治腐败(bai)相结合(he)。完(wan)善信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)修复机(ji)(ji)制(zhi)(zhi)。加快推(tui)进社会信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)立法(fa)(fa)。


三、推进市场设施高标准联通


(八)建(jian)(jian)设(she)现代流(liu)(liu)通(tong)网(wang)络(luo)(luo)。优化(hua)商(shang)贸流(liu)(liu)通(tong)基础(chu)设(she)施布局(ju),加快数字(zi)(zi)化(hua)建(jian)(jian)设(she),推(tui)动线(xian)上线(xian)下(xia)融合发展(zhan),形(xing)成更多(duo)(duo)商(shang)贸流(liu)(liu)通(tong)新(xin)(xin)平台新(xin)(xin)业态新(xin)(xin)模式(shi)。推(tui)动国(guo)(guo)家(jia)物(wu)(wu)流(liu)(liu)枢(shu)纽网(wang)络(luo)(luo)建(jian)(jian)设(she),大力发展(zhan)多(duo)(duo)式(shi)联(lian)运(yun),推(tui)广标准化(hua)托盘(pan)带(dai)板运(yun)输模式(shi)。大力发展(zhan)第三方(fang)物(wu)(wu)流(liu)(liu),支持数字(zi)(zi)化(hua)第三方(fang)物(wu)(wu)流(liu)(liu)交(jiao)付平台建(jian)(jian)设(she),推(tui)动第三方(fang)物(wu)(wu)流(liu)(liu)产业科技(ji)和商(shang)业模式(shi)创新(xin)(xin),培育一(yi)(yi)批有全球影响力的数字(zi)(zi)化(hua)平台企业和供应链企业,促进(jin)全社会物(wu)(wu)流(liu)(liu)降本(ben)增效。加强应急物(wu)(wu)流(liu)(liu)体(ti)系建(jian)(jian)设(she),提升灾(zai)害高风(feng)险(xian)区域(yu)交(jiao)通(tong)运(yun)输设(she)施、物(wu)(wu)流(liu)(liu)站(zhan)点等设(she)防水平和承灾(zai)能力,积极(ji)防范粮食、能源(yuan)等重要产品供应短缺风(feng)险(xian)。完(wan)善国(guo)(guo)家(jia)综合立体(ti)交(jiao)通(tong)网(wang),推(tui)进(jin)多(duo)(duo)层次一(yi)(yi)体(ti)化(hua)综合交(jiao)通(tong)枢(shu)纽建(jian)(jian)设(she),推(tui)动交(jiao)通(tong)运(yun)输设(she)施跨区域(yu)一(yi)(yi)体(ti)化(hua)发展(zhan)。建(jian)(jian)立健全城乡(xiang)融合、区域(yu)联(lian)通(tong)、安(an)全高效的电(dian)信、能源(yuan)等基础(chu)设(she)施网(wang)络(luo)(luo)。


(九)完(wan)善市(shi)场(chang)信(xin)(xin)息(xi)(xi)交(jiao)互渠(qu)道。统一产权交(jiao)易信(xin)(xin)息(xi)(xi)发(fa)布(bu)机(ji)制,实现(xian)全国产权交(jiao)易市(shi)场(chang)联通(tong)(tong)。优化(hua)行业公(gong)(gong)告公(gong)(gong)示(shi)等(deng)(deng)重(zhong)要信(xin)(xin)息(xi)(xi)发(fa)布(bu)渠(qu)道,推动(dong)各领域市(shi)场(chang)公(gong)(gong)共信(xin)(xin)息(xi)(xi)互通(tong)(tong)共享(xiang)。优化(hua)市(shi)场(chang)主体(ti)(ti)信(xin)(xin)息(xi)(xi)公(gong)(gong)示(shi),便利市(shi)场(chang)主体(ti)(ti)信(xin)(xin)息(xi)(xi)互联互通(tong)(tong)。推进同(tong)类(lei)型及同(tong)目的信(xin)(xin)息(xi)(xi)认证平台统一接口建设,完(wan)善接口标准(zhun),促进市(shi)场(chang)信(xin)(xin)息(xi)(xi)流(liu)动(dong)和高(gao)效使用。依法公(gong)(gong)开市(shi)场(chang)主体(ti)(ti)、投资项目、产量、产能等(deng)(deng)信(xin)(xin)息(xi)(xi),引导供需(xu)动(dong)态(tai)平衡(heng)。


(十)推动交易平台(tai)优(you)化升级(ji)。深化公(gong)共(gong)(gong)资(zi)源(yuan)(yuan)交易平台(tai)整合共(gong)(gong)享,研究明(ming)确各类(lei)公(gong)共(gong)(gong)资(zi)源(yuan)(yuan)交易纳入统一(yi)平台(tai)体系的(de)标准(zhun)和方(fang)式(shi)。坚持应进必进的(de)原则要(yao)求(qiu),落实和完(wan)善“管(guan)办分离(li)”制度(du),将公(gong)共(gong)(gong)资(zi)源(yuan)(yuan)交易平台(tai)覆(fu)盖(gai)范(fan)围扩大(da)到(dao)适合以市(shi)场化方(fang)式(shi)配(pei)置的(de)各类(lei)公(gong)共(gong)(gong)资(zi)源(yuan)(yuan),加(jia)(jia)快(kuai)推进公(gong)共(gong)(gong)资(zi)源(yuan)(yuan)交易全流程电子化,积极(ji)破除公(gong)共(gong)(gong)资(zi)源(yuan)(yuan)交易领域的(de)区域壁(bi)垒。加(jia)(jia)快(kuai)推动商品市(shi)场数字化改造(zao)(zao)和智(zhi)能(neng)化升级(ji),鼓(gu)励打造(zao)(zao)综合性商品交易平台(tai)。加(jia)(jia)快(kuai)推进大(da)宗商品期现货市(shi)场建(jian)设(she),不(bu)断完(wan)善交易规(gui)则。鼓(gu)励交易平台(tai)与金(jin)融机(ji)构(gou)、中介(jie)机(ji)构(gou)合作,依法(fa)发展涵盖(gai)产权界定(ding)、价格评估、担保、保险等(deng)业务的(de)综合服务体系。


四、打造统一的要素和资源市场


(十一)健全(quan)城乡(xiang)统一的(de)(de)土地(di)和(he)劳(lao)动力市场。统筹增(zeng)量建(jian)设用(yong)(yong)地(di)与存量建(jian)设用(yong)(yong)地(di),实行统一规划,强化(hua)统一管理。完(wan)善(shan)城乡(xiang)建(jian)设用(yong)(yong)地(di)增(zeng)减挂(gua)(gua)钩节(jie)余(yu)指标、补充耕地(di)指标跨(kua)区域交易机制。完(wan)善(shan)全(quan)国统一的(de)(de)建(jian)设用(yong)(yong)地(di)使用(yong)(yong)权转(zhuan)让、出租、抵押二级市场。健全(quan)统一规范的(de)(de)人(ren)力资源市场体系,促进劳(lao)动力、人(ren)才(cai)跨(kua)地(di)区顺畅流动。完(wan)善(shan)财政(zheng)转(zhuan)移支付和(he)城镇新增(zeng)建(jian)设用(yong)(yong)地(di)规模(mo)与农(nong)业转(zhuan)移人(ren)口市民化(hua)挂(gua)(gua)钩政(zheng)策。

(二(er)十四)破除(chu)地(di)(di)方保护(hu)和(he)区域壁垒。指(zhi)导各(ge)地(di)(di)区综合比较优(you)势(shi)、资(zi)(zi)(zi)源环(huan)境承载能(neng)力(li)、产(chan)业(ye)(ye)基础、防(fang)灾避险能(neng)力(li)等因素,找准自身(shen)功能(neng)定位,力(li)戒贪大(da)求洋、低层次重(zhong)复(fu)建设和(he)过(guo)度(du)(du)同质(zhi)(zhi)竞(jing)争,不搞“小(xiao)而全(quan)”的自我小(xiao)循(xun)环(huan),更不能(neng)以“内(nei)循(xun)环(huan)”的名(ming)义搞地(di)(di)区封锁。建立涉企优(you)惠政(zheng)(zheng)策(ce)目录(lu)清单(dan)并及时(shi)向社会公(gong)开,及时(shi)清理(li)废(fei)除(chu)各(ge)地(di)(di)区含有(you)地(di)(di)方保护(hu)、市场分割、指(zhi)定交易等妨(fang)碍统一市场和(he)公(gong)平(ping)竞(jing)争的政(zheng)(zheng)策(ce),全(quan)面清理(li)歧视(shi)外(wai)资(zi)(zi)(zi)企业(ye)(ye)和(he)外(wai)地(di)(di)企业(ye)(ye)、实行地(di)(di)方保护(hu)的各(ge)类优(you)惠政(zheng)(zheng)策(ce),对新出(chu)台政(zheng)(zheng)策(ce)严格(ge)开展(zhan)公(gong)平(ping)竞(jing)争审查。加强(qiang)地(di)(di)区间产(chan)业(ye)(ye)转移项(xiang)目协调(diao)合作,建立重(zhong)大(da)问题协调(diao)解决机(ji)制,推动产(chan)业(ye)(ye)合理(li)布(bu)局、分工进一步优(you)化。鼓励(li)各(ge)地(di)(di)区持续优(you)化营(ying)商环(huan)境,依(yi)法开展(zhan)招商引(yin)资(zi)(zi)(zi)活(huo)动,防(fang)止(zhi)招商引(yin)资(zi)(zi)(zi)恶(e)性竞(jing)争行为,以优(you)质(zhi)(zhi)的制度(du)(du)供给和(he)制度(du)(du)创新吸引(yin)更多优(you)质(zhi)(zhi)企业(ye)(ye)投(tou)资(zi)(zi)(zi)。


(二十五)清(qing)理(li)(li)废除(chu)妨碍依法(fa)平(ping)等(deng)(deng)准(zhun)入(ru)和(he)(he)退出的规(gui)定(ding)(ding)(ding)做法(fa)。除(chu)法(fa)律(lv)法(fa)规(gui)明确规(gui)定(ding)(ding)(ding)外(wai),不(bu)(bu)(bu)得(de)(de)(de)要(yao)(yao)求(qiu)(qiu)企业(ye)必须在某地登记注册(ce),不(bu)(bu)(bu)得(de)(de)(de)为企业(ye)跨区域经(jing)营或迁移设(she)(she)(she)置(zhi)障(zhang)碍。不(bu)(bu)(bu)得(de)(de)(de)设(she)(she)(she)置(zhi)不(bu)(bu)(bu)合理(li)(li)和(he)(he)歧(qi)视(shi)性的准(zhun)入(ru)、退出条件(jian)以限制商品服(fu)务(wu)(wu)(wu)(wu)、要(yao)(yao)素资源(yuan)自(zi)由流(liu)动。不(bu)(bu)(bu)得(de)(de)(de)以备(bei)案(an)、注册(ce)、年检(jian)(jian)、认(ren)(ren)定(ding)(ding)(ding)、认(ren)(ren)证、指(zhi)定(ding)(ding)(ding)、要(yao)(yao)求(qiu)(qiu)设(she)(she)(she)立分公(gong)司等(deng)(deng)形(xing)式设(she)(she)(she)定(ding)(ding)(ding)或者(zhe)变相(xiang)设(she)(she)(she)定(ding)(ding)(ding)准(zhun)入(ru)障(zhang)碍。不(bu)(bu)(bu)得(de)(de)(de)在资质认(ren)(ren)定(ding)(ding)(ding)、业(ye)务(wu)(wu)(wu)(wu)许可等(deng)(deng)方面,对外(wai)地企业(ye)设(she)(she)(she)定(ding)(ding)(ding)明显高于本地经(jing)营者(zhe)的资质要(yao)(yao)求(qiu)(qiu)、技术要(yao)(yao)求(qiu)(qiu)、检(jian)(jian)验标准(zhun)或评审标准(zhun)。清(qing)理(li)(li)规(gui)范(fan)行政(zheng)(zheng)审批、许可、备(bei)案(an)等(deng)(deng)政(zheng)(zheng)务(wu)(wu)(wu)(wu)服(fu)务(wu)(wu)(wu)(wu)事项(xiang)的前置(zhi)条件(jian)和(he)(he)审批标准(zhun),不(bu)(bu)(bu)得(de)(de)(de)将政(zheng)(zheng)务(wu)(wu)(wu)(wu)服(fu)务(wu)(wu)(wu)(wu)事项(xiang)转为中介服(fu)务(wu)(wu)(wu)(wu)事项(xiang),没(mei)有法(fa)律(lv)法(fa)规(gui)依据(ju)不(bu)(bu)(bu)得(de)(de)(de)在政(zheng)(zheng)务(wu)(wu)(wu)(wu)服(fu)务(wu)(wu)(wu)(wu)前要(yao)(yao)求(qiu)(qiu)企业(ye)自(zi)行检(jian)(jian)测、检(jian)(jian)验、认(ren)(ren)证、鉴(jian)定(ding)(ding)(ding)、公(gong)证以及(ji)提(ti)供证明等(deng)(deng),不(bu)(bu)(bu)得(de)(de)(de)搞变相(xiang)审批、有偿(chang)服(fu)务(wu)(wu)(wu)(wu)。未经(jing)公(gong)平(ping)竞争不(bu)(bu)(bu)得(de)(de)(de)授(shou)予经(jing)营者(zhe)特许经(jing)营权,不(bu)(bu)(bu)得(de)(de)(de)限定(ding)(ding)(ding)经(jing)营、购买、使(shi)用特定(ding)(ding)(ding)经(jing)营者(zhe)提(ti)供的商品和(he)(he)服(fu)务(wu)(wu)(wu)(wu)。


(二十六)持(chi)续清(qing)理招标采(cai)(cai)(cai)购领域(yu)违(wei)反统(tong)一市场建设(she)的(de)(de)规(gui)定(ding)和做法(fa)。制定(ding)招标投(tou)标和政(zheng)府采(cai)(cai)(cai)购制度规(gui)则要严格(ge)按(an)照国(guo)家有关规(gui)定(ding)进行公平竞争审(shen)(shen)查、合(he)法(fa)性审(shen)(shen)核。招标投(tou)标和政(zheng)府采(cai)(cai)(cai)购中严禁违(wei)法(fa)限(xian)定(ding)或者(zhe)指(zhi)定(ding)特(te)定(ding)的(de)(de)专利、商标、品(pin)牌、零部件、原产地(di)(di)、供应商,不得(de)违(wei)法(fa)设(she)定(ding)与(yu)招标采(cai)(cai)(cai)购项目具体特(te)点和实际(ji)需要不相适应的(de)(de)资格(ge)、技术(shu)、商务条件等。不得(de)违(wei)法(fa)限(xian)定(ding)投(tou)标人所(suo)在地(di)(di)、所(suo)有制形式、组织形式,或者(zhe)设(she)定(ding)其(qi)他不合(he)理的(de)(de)条件以排斥、限(xian)制经营者(zhe)参(can)与(yu)投(tou)标采(cai)(cai)(cai)购活(huo)动。深入推(tui)进招标投(tou)标全流程电(dian)子化,加快(kuai)完善电(dian)子招标投(tou)标制度规(gui)则、技术(shu)标准(zhun),推(tui)动优质(zhi)评标专家等资源跨(kua)地(di)(di)区跨(kua)行业共享。


八、组织实施保障


(二十七)加(jia)强党的领(ling)导。各(ge)(ge)(ge)地区各(ge)(ge)(ge)部门要(yao)(yao)充(chong)分认识(shi)建(jian)设(she)全国统一(yi)大市(shi)场对于构建(jian)新发(fa)展格局的重要(yao)(yao)意义,切实(shi)把思想和行动统一(yi)到(dao)党中央决策部署上来,做(zuo)到(dao)全国一(yi)盘(pan)棋,统一(yi)大市(shi)场,畅通(tong)大循环,确保(bao)各(ge)(ge)(ge)项重点任务落(luo)到(dao)实(shi)处。


(二十八)完善(shan)激励(li)约束机制。探索研究全(quan)(quan)(quan)国(guo)(guo)(guo)统一(yi)大(da)(da)市场(chang)建(jian)设(she)标准(zhun)指(zhi)南,对(dui)积极推(tui)动(dong)(dong)落实全(quan)(quan)(quan)国(guo)(guo)(guo)统一(yi)大(da)(da)市场(chang)建(jian)设(she)、取得突出(chu)成(cheng)效的地(di)区可按(an)国(guo)(guo)(guo)家有关规(gui)定予以奖励(li)。动(dong)(dong)态发布不(bu)当干预全(quan)(quan)(quan)国(guo)(guo)(guo)统一(yi)大(da)(da)市场(chang)建(jian)设(she)问题清单,建(jian)立典型(xing)案例通报约谈和问题整改制度,着力(li)解(jie)决妨碍全(quan)(quan)(quan)国(guo)(guo)(guo)统一(yi)大(da)(da)市场(chang)建(jian)设(she)的不(bu)当市场(chang)干预和不(bu)当竞争行为(wei)问题。


(二十九)优先(xian)推进区(qu)域(yu)(yu)协作(zuo)。结(jie)合(he)区(qu)域(yu)(yu)重(zhong)大(da)战略(lve)、区(qu)域(yu)(yu)协调(diao)发展(zhan)战略(lve)实施,鼓(gu)励京(jing)津冀、长三角、粤港澳大(da)湾区(qu)以(yi)及成渝地(di)区(qu)双城经(jing)济圈、长江中游城市(shi)群等(deng)区(qu)域(yu)(yu),在维护全国(guo)统(tong)一(yi)大(da)市(shi)场前提(ti)下(xia),优先(xian)开展(zhan)区(qu)域(yu)(yu)市(shi)场一(yi)体化建设工作(zuo),建立(li)健全区(qu)域(yu)(yu)合(he)作(zuo)机制,积(ji)极总结(jie)并复制推广典型经(jing)验和做(zuo)法。


(三十)形成(cheng)工作合(he)力。各(ge)(ge)地(di)区各(ge)(ge)部(bu)门要(yao)根(gen)据职责分工,不折不扣落实本(ben)意见要(yao)求,对本(ben)地(di)区本(ben)部(bu)门是否存(cun)在妨碍全(quan)(quan)国(guo)统一大(da)(da)市(shi)(shi)场建(jian)设的(de)(de)规定(ding)和实际情况开(kai)展自查清理。国(guo)家(jia)发展改(gai)革委、市(shi)(shi)场监管(guan)总局(ju)会同有关部(bu)门建(jian)立健(jian)全(quan)(quan)促进全(quan)(quan)国(guo)统一大(da)(da)市(shi)(shi)场建(jian)设的(de)(de)部(bu)门协调(diao)机制(zhi),加大(da)(da)统筹协调(diao)力度(du),强化跟(gen)踪评(ping)估,及时(shi)(shi)督促检查,推动各(ge)(ge)方(fang)抓(zhua)好贯彻落实。加强宣传引导和舆论监督,为(wei)全(quan)(quan)国(guo)统一大(da)(da)市(shi)(shi)场建(jian)设营造良好社会氛围。重大(da)(da)事项(xiang)及时(shi)(shi)向党(dang)中央、国(guo)务院请(qing)示报(bao)告(gao)。
